Guidelines for the use of certain copyrighted materials.

The following guidelines are provided for the use of certain copyrighted materials, such as images, box shots, screen shots, and text; and for the use of certain trademarked materials, such as logos, marks, and icons. These materials are owned by Futurete Technologies International Limited ("Futuretech") and provided under license.

To use such materials, you must first agree to the following license terms:

• The materials available for download within Powow are subject to these license terms, as well as any specific guidelines contained herein. If you download any materials from Powow, you agree to be bound by these license terms as well as the specific guidelines related to the materials you wish to download.
• You may not sell, alter, modify, license, sublicense, copy, or use the materials in any way other than has been specifically authorized by Futuretech in the permissions and trademark guidelines described herein.
• You acknowledge that Futuretech reserves the right to revoke the authorization to view, download, and print the materials available on this site at any time, and for any reason; and such authorization shall be deemed to be discontinued immediately upon the removal of these materials from the site.
• You acknowledge that any rights granted to you constitute a license and not a transfer of title. You do not obtain any ownership right, title, or other interest in Futuretech copyrighted materials or trademarks by downloading, copying, or otherwise using these materials.
• FUTURETECH SHALL NOT BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY LOSS OF REVENUE OR PROFIT OR FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER SIMILAR DAMAGES, WHETHER BASED ON TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE OR STRICT LIABILITY), CONTRACT, OR OTHER LEGAL OR EQUITABLE GROUNDS EVEN IF FUTURETECH HAS BEEN ADVISED OR HAD REASON TO KNOW OF THE POSSIBILITY OF SUCH DAMAGES.
• ANY MATERIALS ARE PROVIDED ON AN "AS IS" BASIS. FUTURETECH SPECIFICALLY DISCLAIMS ALL EXPRESS, STATUTORY, OR IMPLIED WARRANTIES RELATING TO THESE MATERIALS, INCLUDING BUT NOT LIMITED TO THOSE CONCERNING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS REGARDING THE MATERIALS.

Use of images

Stock art, clip art, and photographs

Any digital images, stock photographs, clip art, or other artistic work (collectively "images") delivered with any Powow product may be used in accordance with the rights set out in the End-User License Agreement that ships with that Powow product. If your intended use falls within the terms of the End-User License Agreement or other product documentation, further written permission is not required.

Any use of images delivered with an Powow product and not provided for in the End-User License Agreement requires written permission from Powow. In some instances, images included in Powow products may be owned by a third party and licensed under terms different than those contained in the Powow End-User License Agreement. Under these circumstances, the Terms of Use for third-party images are stated in ReadMe or text files associated with that image. If you are seeking to use third-party images or content outside the scope permitted in the terms of the ReadMe or text files, please contact the copyright owner directly for permission. It is unlikely that Powow will be able to grant permission beyond that contained in the End-User License Agreement due to contractual restrictions, third-party rights, and other intellectual property restraints.

If you are still interested in requesting special permission for an Powow image send an e-mail to permissions@futuretech.net.nz. Please allow two weeks for your request to be processed.

Under no circumstances will Powow license the reproduction, distribution, or modification of any third-party images displayed within Powow.

Screenshots

Screenshots are individual print screens contained within Powow software applications. You may use screenshots in advertising, on documentation (including educational brochures), in tutorial books, in videotapes, or on websites, provided you adhere to the following guidelines:

• Your use may not be obscene or pornographic, and may not be disparaging, defamatory, or libelous to Powow, any of its products, or any other person or entity.
• Your use may not directly or indirectly imply Powow sponsorship, affiliation, or endorsement of your product or service.
• You may not use the screenshot in a comparative advertisement.
• You may not alter the screenshot in any way except to resize the screenshot. Your use must contain the entire screenshot. You may not use portions of the screenshots, and no portions of a screenshot may be included in your product user interface.
• You may not use screenshots from Powow beta products or other products that have not been commercially released by Powow.
• You may not use screenshots that contain third-party content.
• You must include the following copyright attribution statement: "Powow product screenshot(s) reprinted with permission from Future Technologies International Limited."
• If your use includes references to an Powow product, the full name of the product must be referenced at the first and most prominent mention (such as Powow™ Online Conferencing and Collaboration). When referencing any Powow trademarks, please mark them with a ™ or ® as indicated.
• If your use includes references to any Powow trademarks, you should include the following trademark attribution statement: "[List of marks used, with 'Powow' first, if used, followed by other Powow marks used, in alphabetical order] are either registered trademarks or trademarks of Powow or Future Technologies International Limited in the United States and/or other countries."
• Screenshots must be reproduced in their entirety. Permission may be given in certain limited circumstances, however, to use specific portions of a screenshot. Get permission to use a screenshot in this manner.

If your use meets the above criteria, no further written permission is required. All other uses require written permission from Powow, including use of screenshots in or on a television program, movie, or commercial. If further written permission is required send an e-mail to permissions@futuretech.net.nz. Please allow two weeks for your request to be processed.

Please note that Powow cannot give permission for use of any third-party content (artwork) that may be contained within an Powow screenshot. To determine whether an image contained within an Powow screenshot belongs to a third party, refer to the guidelines on stock art, clip art, and photographs.

Use of Powow user guides

Powow does not object to your use of Powow user guides for educational purposes, provided the following guidelines are adhered to:

• Your use may not be obscene or pornographic, and may not be disparaging, defamatory, or libelous to Powow, any of its products, or any other person or entity.
• Your use may not directly or indirectly imply Powow sponsorship, affiliation, or endorsement of your product or service.
• You reproduce no more than two chapters of the product user guide, and such chapters may only be distributed to your students for educational purposes. The copyright page of the product user guide must accompany such documents.
• You may not alter the Powow user guide or any material contained therein in any way.
• You must include the following copyright attribution statement: "© (Copyright symbol) (year) with express permission from Future Technologies International Limited (futuretech)" in a conspicuous location with the materials.

If your use meets the above criteria, no further written permission is required. All other use of instructional materials requires written permission send an e-mail to permissions@futuretech.net.nz. Please allow two weeks for your request to be processed.
